Short answer

In Croatia, profit from selling crypto is taxed at 12% (no surtax since 2024), only when you exchange it for euros or other money and only if you held it less than two years. Swapping one coin for another is not taxed. You calculate the year's net gain yourself (FIFO, minus fees and same-year losses), report it on the JOPPD form in ePorezna and pay by the end of February of the next year.

Swaps: the rule that matters for meme coins

Porezna uprava's opinion is that exchanging one cryptocurrency for another does not create a taxable gain at that moment, because no money changes hands. Its example: 10 BTC bought for $6,000, swapped for ETH, later sold for $35,400: the taxable gain of $29,400 is counted when the ETH is sold for money. For a Solana trader this means SOL to meme coin and back to SOL is not taxed until you cash out to euros, but you still need the records to calculate the gain then.

How to calculate the gain

  1. Export every buy, sell and swap from each exchange and wallet for the year.
  2. For each sale for money, take the cost of the oldest coins first (FIFO).
  3. Gain = sale amount minus cost minus fees. Add all gains, subtract all losses of the same year.
  4. Skip coins held longer than two years; they are exempt.
  5. Tax = 12% of the net gain.

How to file JOPPD

  1. Log in to ePorezna (with e-Građani credentials) and open a new JOPPD form.
  2. Fill it in for the previous year's total capital gains, dated 31 December of that year.
  3. Submit and pay the tax to the account shown, by the end of February (for 2026 gains: end of February 2027).
  4. Keep the exports and your calculation; the tax office can ask for them.

Since 2026 EU rules (DAC8) require crypto service providers to collect and report their customers' transactions to tax authorities, so cross-checks will become routine.

Other income

Crypto earned from mining, tasks or promotions is not a capital gain: Porezna uprava treats it as "other income" (drugi dohodak), taxed differently, and regular mining as a business may need a registered activity. Staking rewards are not covered by a published opinion; ask before you file. For companies the rules are completely different, see can a company invest in crypto in Croatia.
